Prolepha Research B.V. (hereafter Prolepha) may process your personal data. We have therefore drawn up a policy, which explains how your personal data are processed and protected.

Prolepha is the administrator of the personal data that you provide to us and is responsible for your personal data under the applicable data protection law.

The data we collect from you are stored within the European Economic Area (“EEA”), and can be transferred to and processed in a country outside the EEA if there is a legal basis.

We will never forward, sell or share your information with third parties for marketing purposes. Information that is forwarded to third parties is only used to provide you with our services or if necessary to comply with the legislation.

If we process or transfer personal data from you, we will inform you whether it is legally required or necessary for the processing or transfer of personal data to conclude an agreement, whether it is an obligation to provide the personal data and what the possible consequences are if you choose not to do so.

You have the right to have your personal data removed by Prolepha except in the following situations:

  1. you have a pending complaint

When Prolepha processes your personal data in an automated manner on the basis of your consent or on the basis of an agreement, you have the right to obtain a copy of your data in a structured, generally used and machine readable format. This only applies to the personal data that you have provided to us.

You have the right to object to the processing of your personal data in case of a legitimate interest of Prolepha. Prolepha will not continue to process the personal data, unless Prolepha can provide a legal basis for the process that outweighs your interests and rights.

If you are of the opinion that Prolepha does not process your personal data correctly, we ask you to report this to us so that we can process your complaint. You also have the right to file a complaint with a supervisory authority.

Whose personal data do we use and process? In this we make the following subdivision.

CUSTOMERS AND SUPPLIERS

We use your personal data to process your deliveries, orders and return shipments and to inform you about the delivery status or any problems with regard to the delivery. We also store data to answer questions, handle complaints and warranty issues for products. Finally, we use your personal data to manage your payments.

We process the following categories of personal data:

  • Contact details, such as name, address, e-mail address and telephone number
  • payment details and payment history
  • order data
  • purchase history

Our Prolepha employees involved in the process from ordering to paying have access to your personal data. Your personal data will be forwarded to third parties, warehouse and distribution partners in connection with the delivery of your order, payment service providers for your payment and collection agencies if applicable.

The processing of your personal data is necessary to process your order and the subsequent delivery.

We keep your personal data as long as you are employed by an active customer or supplier or until you indicate that you have deleted your personal data.

END USER AND HEALTHCARE PROFESSIONAL

If you have medical questions, side effects and complaints regarding the use of our products by telephone, via the contact form on our website or via email, we will register them and also record your contact details. These contact details are only used to contact you regarding the specific medical questions you have asked or reported, side effects and complaints with a view to follow-up, obtaining more information and to answer your questions. Patient information regarding an adverse reaction is recorded in order to meet our obligation to be able to monitor the safety of the products we bring onto the market.

We process the following personal data:

  • Contact details of the detector: name, address, telephone number and / or e-mail address
  • Initials, date of birth, gender, age or age category, relevant information for the reported adverse reaction (including any medical history, co-medication), possibly contact details of your prescriber / pharmacy (when reporting an adverse reaction)

Prolepha’s employees who are responsible for registering and following up medical questions, side effects and complaints have access to your personal data in this case. We also have the obligation to report adverse reactions to national or European authorities for pharmacovigilance. In addition, it is possible that the personal data collected for the registration of an update is shared with third parties if they are responsible for reporting the update of a specific product or if obligations regarding the exchange of information concerning product safety so require.

The processing of your personal data is based on your permission that you give when you report the medical question, update or complaint.

Legislation on pharmacovigilance legislation requires that we, as supplier of our products, record the side effects and that they are traceable. It is important that sufficient information is available so that we can contact you to log as complete as possible.

You have the right to view, correct and withdraw your personal data at any time for the processing of your personal data (via info@prolepha.nl ). Information collected in the context of adverse reactions cannot be removed due to legislation, unless the recorded information is incorrect.

We store your data in accordance with pharmaceutical legislation in Europe.

COMPLIANCE WITH LEGAL FRAMEWORKS

We use your personal data to comply with the legal obligations, court decisions and decisions of authorities. This includes the use of your personal data to collect and verify accounting data in order to comply with the accounting rules.

We process the following categories of personal data:

  • clientnumber
  • order number
  • contact details: name and postal address
  • transaction amount
  • transaction date

Your data is transparent for Prolepha employees who are invested with this task.

The processing of your personal data is necessary for Prolepha to comply with its legal obligation.

We keep your data in accordance with the tax regulations in the Netherlands
